Booking Conditions

These conditions govern the tourist accommodation contract between the guest and Botanical Apartment Modena. By completing your booking and payment you declare that you have read and fully accepted them.

3. Tourist tax

The Municipality of Modena's tourist tax is not included in the price and is paid separately through the Chekin platform, according to the rates and exemptions set by the Municipality.

Refunds are issued to the original payment method within 14 days of the cancellation request. To cancel, write to riccardomingarelli33@hotmail.it: the date the notice is received applies. No-show without notice gives no right to a refund.

6. Right of withdrawal

Important. Under Article 16(l) of Directive 2011/83/EU, implemented in Italy by Art. 59(1)(n) of the Consumer Code (Legislative Decree 206/2005), the 14-day right of withdrawal for distance contracts does not apply to contracts for the provision of accommodation other than for residential purposes where the contract provides for a specific date or period of performance. By booking specific dates at Botanical Apartment Modena, the guest acknowledges that the right of withdrawal cannot be exercised: only the cancellation policy in section 5 applies.

7. ZTL pass and parking

The ZTL pass is included free of charge. To activate it you must provide your vehicle number plate when booking or in any case before arrival. The pass is requested from the Municipality of Modena for the days of your stay. The owner is not liable for fines arising from plates communicated incorrectly, late or incompletely, nor for parking in unauthorised areas.

9. Liability

The owner is not liable for personal belongings forgotten or lost, nor for disruptions caused by force majeure (interruptions to electricity, water or internet beyond his control). Should provision of the accommodation become impossible for reasons not attributable to the guest, the amount paid will be refunded in full, excluding any further claim.

10. Complaints and jurisdiction

Any complaint should be raised promptly during the stay so that it can be resolved quickly. The contract is governed by Italian law. For consumers, the court of their place of residence or domicile has jurisdiction. The European online dispute resolution platform is also available: ec.europa.eu/consumers/odr.
